What if I told you ANY case that deals with medical records NEEDS a Medical legal consultant? No joke!
Here are a few types of cases where I have been used and how I was utilized:
1. Medical malpractice – i.e. a patient was injured while receiving treatment. I screened the case for merit, located experts, assisted with depositions, and trial.
2. Personal Injury – i.e. car accident. I reviewed the medical records and summarized the injuries sustained and the long-term medical needs of the patient.
3. Fraud – i.e. Medicare fraud (the facility is billing for more tests than are necessary or deemed appropriate by medical standards). I reviewed the records, identified when billing occurred, and assessed medical necessity for said tests.
4. Employment law – i.e. employee is fired after he/she is diagnosed with a condition without reasonable accommodation. I reviewed the medical records and provided literature to support the symptoms the client was experiencing. I also ensured the patient had appropriate medical tests to fully support the diagnosis and accommodations needed.
5. Case management – i.e. submitting expenses to the trust in birth injury cases. Ensuring the injured patient gets all supplies approved per trust guidelines.
So, really any case that has medical issues can benefit from having the MD legal consultant. My clients reap the benefits of having an experienced physician consultant on the team.
